SMS Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the Gray Reserve SMS messaging program. Gray Reserve (“Company,” “we,” “us,” or “our”) is located at 32403 Tamina Road, Suite 2, Magnolia, Texas 77354. By opting in to receive SMS messages from Gray Reserve, you agree to these SMS Terms. Our SMS program complies with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. §227, the FCC’s implementing regulations, the CAN-SPAM Act, CTIA Messaging Principles and Best Practices, and applicable Texas state law.

1. Program Description

Gray Reserve’s SMS program delivers text messages related to our services, including but not limited to: service updates and communications, consultation confirmations and appointment reminders, marketing and promotional messages, intelligence briefings and business insights, and transactional notifications related to active engagements. Message frequency varies based on your interactions and engagement status. You may receive up to 10 messages per month. Promotional messages will be clearly identified.

2. Consent and Opt-In

By providing your mobile phone number and affirmatively consenting through one of the following methods, you expressly consent to receive recurring automated marketing and informational text messages from Gray Reserve:

(a) Website Form Opt-In. Submitting a form on grayreserve.com with the SMS consent checkbox selected and your mobile phone number provided.

(b) Keyword Opt-In. Texting a designated keyword (e.g., “RESERVE”) to our business phone number.

(c) Verbal or Written Consent. Providing express written or verbal consent during a consultation or engagement.

Consent is not a condition of purchasing any goods or services from Gray Reserve. You are not required to opt in to SMS messages to receive our services. Messages may be sent using an automatic telephone dialing system or prerecorded voice technology as defined under the TCPA.

3. Opting Out

You may opt out of receiving SMS messages at any time by any of the following methods:

(a) Reply STOP. Reply “STOP,” “UNSUBSCRIBE,” “CANCEL,” “END,” or “QUIT” to any message received from us.

(b) Email. Send an opt-out request to [email protected] with the subject line “SMS Opt-Out” and include your phone number.

(c) Phone. Call us at (936) 363-1823 during business hours to request removal.

Upon receiving your opt-out request, we will send a single confirmation message confirming that you have been unsubscribed. No further messages will be sent unless you re-opt-in. We will process opt-out requests within a reasonable timeframe, not to exceed 10 business days. Please note that opting out of SMS messages does not affect other communications such as email or service-related notifications governed by your client agreement.

4. Help and Support

For help or information regarding our SMS program, reply HELP to any message received from us, email [email protected], or call (936) 363-1823. Our support hours are Monday through Friday, 9:00 AM to 5:00 PM Central Time.

5. Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier and plan. Gray Reserve is not responsible for any charges incurred from receiving SMS messages. Contact your wireless carrier for details regarding your messaging plan and any applicable charges. If your mobile plan does not include text messaging, you will be charged by your carrier per message received.

6. Privacy and Data Use

Your mobile phone number and information collected through our SMS program are handled in accordance with our Privacy Policy and the following additional protections:

(a) We do not sell, rent, lease, or share your mobile phone number or any information collected through our SMS program with third parties or affiliates for their marketing purposes.

(b) We may share your information with service providers who assist in delivering SMS messages (e.g., our SMS platform provider), provided they are contractually bound to use such information only for the purpose of delivering messages on our behalf and to maintain confidentiality.

(c) Data collected through the SMS program may include your mobile phone number, carrier name, date, time, and content of your messages, and opt-in/opt-out status.

(d) We retain your SMS program data for as long as you are subscribed to the program, plus a reasonable period after opt-out for compliance and record-keeping purposes, after which it is securely deleted.

7. Supported Carriers

Our SMS program is supported by all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, U.S. Cellular, and most regional carriers. Carriers are not liable for delayed or undelivered messages. Service availability and message delivery may vary by carrier and geographic location.

8. Disclaimer and Liability

To the maximum extent permitted by Texas law:

(a) Gray Reserve and its SMS service providers are not liable for delayed, undelivered, or misdirected messages resulting from carrier network issues, device incompatibility, or circumstances beyond our reasonable control.

(b) T-Mobile and all other carriers are not liable for delayed or undelivered messages.

(c) Gray Reserve is not responsible for any damages arising from your participation in the SMS program, including but not to data charges incurred by your carrier.

(d) The information provided via SMS is for general informational purposes and does not constitute professional advice. Service-specific communications are governed by the applicable client agreement.

9. TCPA Compliance

Gray Reserve maintains records of all consent obtained for SMS communications in compliance with the TCPA. We do not send unsolicited SMS messages to numbers on the National Do Not Call Registry without prior express written consent. We honor all opt-out requests promptly. Our SMS practices comply with FCC regulations regarding autodialed calls and texts, and we maintain internal Do Not Call lists that are updated upon receipt of each opt-out request.

10. Texas-Specific Provisions

In addition to federal TCPA requirements, our SMS program complies with the Texas Business & Commerce Code and applicable Texas consumer protection regulations. Texas residents retain all rights provided under the Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code §17.41 et seq.), the Texas Data Privacy and Security Act, and any other applicable state consumer protection statutes. These SMS Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising from these SMS Terms shall be resolved in the state or federal courts of Montgomery County, Texas.

11. Changes to SMS Terms

Gray Reserve reserves the right to modify these SMS Terms at any time. Changes will be effective upon posting to this page with an updated “Last updated” date. Continued participation in our SMS program after changes are posted constitutes acceptance of the updated terms. For material changes, we will send an SMS notification providing the updated terms or a link to the updated terms page.
